1 OPERATIONS

Our entire fleet of vehicles can be driven by persons with a category B driver’s license. Before a rental is arranged, we require a copy of your driver’s license, which can either be uploaded online or sent to us via WhatsApp. Payment is made exclusively via TWINT bank transfer. We do not charge a deposit and ask for your understanding that payment must be made in advance before the start of the rental period. In case a second driver is driving the rented vehicle, it is necessary to inform ONA Group GmbH “SUBITOBUS.CH” about it. A fee of CHF 35.00 will be charged for each additional driver.

2 INSURANCE

The rental contract of ONA Group GmbH “SUBITOBUS.CH” includes partial comprehensive insurance. The deductible for liability and comprehensive insurance is CHF 1,500 per claim. This includes damage to other property and vehicles. Please note that goods in transit and personal belongings of the renter are not covered by this insurance. It is expressly not permitted to drive the rented vehicles on race tracks, to perform towing or test drives (without express permission from us) or to sublet the vehicle to third parties. Mechanical damage or damage to windshields, tires, the underbody, car keys, rims and vehicle superstructures caused by improper or careless use or failure to observe the overall height of the vehicle are the responsibility of the renter.

3 FUEL COSTS

All vehicles of ONA Group GmbH “SUBITOBUS.CH” are handed over with a full tank and must be returned with a full tank as well. It is critical that the correct fuel is used for the vehicle in question. In the event of damage caused by incorrect refueling, the lessee shall be fully liable. Please note that fuel is not included in the rental price. When returning the vehicle, we ask to send a fuel receipt or photos of the dashboard via WhatsApp. Should the vehicle not be returned with a full tank of fuel, the renter will be charged for the missing tank content plus a handling fee of CHF 50.

4 RENTAL VEHICLES

ONA Group GmbH “SUBITOBUS.CH” reserves the right to change the reservation to a vehicle of another manufacturer of the same category, should the originally requested model not be available. It should be noted that a reservation does not constitute a binding contract between the customer and SUBITOBUS.CH. SUBITOBUS.CH has the right to refuse a rental at its own discretion.

5 LIABILITY

ONA Group GmbH “SUBITOBUS.CH” assumes no liability for inconveniences and failures of any kind. The renter bears full responsibility, even if the vehicle is left to third parties or used by passengers. In addition, the renter is liable for self-caused defects in the rental vehicle, for example, due to overloading, damage to the clutch, tires and the like. Should the Lessee select a breakdown service other than that of Intertour Winterthur, the Lessee shall bear the costs incurred for this. The tenant is also liable for all unauthorized actions, such as improper waste disposal and the like. It is therefore of the utmost importance to comply with the regulations governing the use of the vehicle.

6 COLLECTION AND RETURN

On the contractually agreed return date, the vehicle will be carefully inspected by our staff at the pick-up location. Therefore, we ask you to proactively inform us about any damage, defects and other extraordinary events. As a renter, you are required to take photos to document the condition of the vehicle when you pick it up as well as after you return it and send them to us via WhatsApp. If new damage is found during the inspection after return, it will be assigned to the renter and noted accordingly as damage. In this case, the tenant is liable for the costs incurred. It is important to note that returning the vehicle early or driving fewer miles will not result in a reduction of the rental cost. Furthermore, the vehicle must be in a clean condition when returned.

6 CANCELLATION OF THE RESERVATION

Cancellations of individual reservations are free of charge, provided they are made within 48 hours in writing or through our booking system. If the cancellation is not made in time, a fee of 50% of the booking amount will be charged. In the absence of written cancellation, the full amount of the booking must be paid.

7 CANCELLATION OF CONTRACT

The rental relationship can be terminated immediately and without express notice on the part of ONA Group GmbH “SUBITOBUS.CH”: This applies if the renter makes false statements to ONA Group GmbH “SUBITOBUS.CH”, in case of default of payment or the opening of bankruptcy proceedings. In any case of termination of the lease agreement, the Lessee is obliged to return the vehicle immediately. Furthermore, ONA Group GmbH “SUBITOBUS.CH” reserves the right to retrieve the vehicle itself, even if it is on private property. All related costs are to be borne by the tenant personally.

8 CONTRACT EXTENSION

An extension of the lease is possible only with the prior consent of ONA Group GmbH “SUBITOBUS.CH” and before the termination of the current lease. ONA Group GmbH “SUBITOBUS.CH” reserves the right to refuse an extension without giving reasons. Should the customer exceed the rental time or return the vehicle late, a fee of CHF 25.00 per additional hour will be charged.

9 RENTAL

Payment of the rental price shall be made before or after the rental period “at the latest when the rental vehicle is returned (only for corporate customers)”, the rental amount must then be paid immediately via TWINT or credit card. In case of non-payment of the rental amount we charge CHF 20.00 for invoicing/payment reminder. If the invoice is not paid, an immediate debt collection will be carried out with an administrative fee of CHF 200.00. Payments via credit card, Apple Pay and Google Pay as well as Paypal, we charge a transaction fee of 3%.

10 TURNOVER COMPENSATION

For the forwarding of fines within Switzerland, we charge a fee of CHF 20.00 and abroad we charge a fee of CHF 50.00. If the vehicle has been parked incorrectly, we will charge a fee of CHF 25.00 for correct parking. In the event that an invoice is not paid, a processing fee of CHF 25.00 will be charged. If the rental vehicle is not returned cleaned, we will charge a cleaning fee of CHF 60.00 per hour, with a minimum charge of CHF 60.00.

11 SPECIAL EQUIPMENT OF THE VEHICLES

The rented vehicle may be equipped with a crash box, a remaining odometer or a GPS. The renter agrees to the use of this data in case of accidents, to ensure vehicle safety and in case of discrepancies. It is important to note that different laws apply in different EU countries regarding the accessories to be carried. The lessee is responsible for compliance with these regulations.

12 ACCIDENTS/REPAIRS OF TECHNICAL DEFECTS

Not insured and not permitted are: Driving off public roads and off-road, driving outside Europe, driving without the required driver’s license, learning to drive, towing and car racing. Damage caused by drunkenness (with more than 0.5 per mille blood alcohol content), under the influence of narcotics or medication is also not insured. Likewise, damage caused by disregarding the minimum altitude, exceeding the speed limit, negligent behavior, during riots of any kind and by warlike events are not insured.
